Privacy Policy

Article 1: Lexicon 

For the sake of clarity, in the articles below

  • “Editor”: means the company Delys Private
  • “Site: means the Internet website accessible via https://www.delysprivate.com 
  • “User”: means any individual visiting one or several pages of the Site. 

Article 2: Personal Data Protection 

The Editor undertakes to comply with the rules of: 

  • EU Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data
  • French Law n° 2018-493 of 20 June 2018 on the protection of personal data  
  • French Law n° 78-17 of 6 January 1978 on computing, files and freedom, as amended by various decrees, including decree n° 2019-536 of 29 May 2019, 
  • French Law n° 2004-575 of 21 June 2004 for trust in digital economy,  
  • French Code on mails and digital communications, Book II digital communications

and to take all necessary caution to preserve security of the entrusted personal information.

Article 4 – Legitimate basis for the process

The basis of the process is consent.

It is the User who decides to fill out the contact form in the heading “contact”.  

Likewise, the User may at any time decide to withdraw the consent as indicated in the heading “erasing right”. 

Article 5 – Categories of processed personal data  

The categories of personal data processed in the heading “contact” are: name, surname, email address. 

Article 6 – Use of the personal data collected via the headings

The User may contact the Editor through the form available on the Site to require information on the Editor’s Services, require an appointment, or candidate for an internship or a job … 

The Editor may apply any means to answer to any request from any User.  Nevertheless, it does not undertake to confirm receipt of the User’s request.  

Article 7 – Recipients of the collected personal data

The Editor and certain service providers managing the Site’s backup, the hosting and the technical tools are the sole recipients of the collected personal data.  

No personal information of the User is published unknown to the User, exchanged, transferred, assigned or sold on any medium to third parties.  

The transmission of such information would be allowed only in the event of the purchase of DELYS PRIVATE and of its rights.  In such an event, the information would be transferred to the purchaser and such purchaser would be under the same conservation and modification obligation of the data to the benefit of the User. 

Article 8 – Storage periods of the collected personal data 

Storage periods are: 

  • for an information request on our products and services: 3 years after the last contact for the prospection with the User, who is entitled to request the end of the solicitations at any time, 
  • For any other request in the month following the Editor’s answer. 

Article 9 – Protection of the collected personal data

The Editor undertakes to work to ensure the security and confidentiality of the data processed on its processing software.  The Site is secured according to HTTPS protocol, which means that the data transferred between the Site and the User is encrypted. 

Article 10 – Storage place of the data 

The storage of the orders is performed on a server located in France.

Once the email containing the contact forms or the requests for quotes has been transferred, the request is processed by the Editor and the User’s data is stored on its “clients relationship software” in France.  The same process applies to the data registered on the User’s account. 

Article 11 – Access right 

According to the relevant regulation, each User benefits from an access right on their personal data.

The Editor shall nevertheless check the identity of the applicant, as a precaution, through a signed identity document before granting to such applicant any access to their personal data. 

Article 12: Rectification right 

According to the relevant regulation, each User benefits from a rectification right on their personal data.  

Such right allows the rectification, completion, updating, locking or erasing of the inaccurate, incomplete, equivocal or outdated personal data.

The Editor shall nevertheless check the identity of the applicant, as a precaution, through a signed identity document before granting to such applicant any access to his/her personal data. 

Article 13 – Erasing right 

Each User benefits, according to the relevant regulation, from an erasing right on the relevant personal data. 

Such rights allow the erasure of the personal data.

The Editor shall nevertheless check the identity of the applicant, as a precaution, through a signed identity document before erasing the applicant’s personal data before the end of the storage period (see article Storage periods of the collected personal data). 

Article 14 – Opposition right for legitimate ground 

The Editor shall consider any opposition to the use of the personal data, according to the above principles.

The Editor shall nevertheless check the identity of the applicant, as a precaution, through a signed identity document before processing such opposition. 

Article 15 –Process limitation right 

Each user benefits, according to the relevant regulation, from a limitation right on the relevant personal data processing, i. e. a right to freeze the data at a specific moment.

The Editor shall nevertheless check the identity of the applicant beforehand, as a precaution, through a signed identity document. The Editor shall notify the User of the end of the limitation. 

Article 16 – Cookies 

Browsing on the Site may induce the installation of cookie(s) on the User’s computer.  A cookie is a small file that doesn’t enable the identification of the User, but records information related to the browsing of a computer on a site.  Such data is intended to facilitate subsequent browsing on the site and to enable various attendance measurements. 

Article 17 – Cookies settings 

Refusing the installation of a cookie may result in the inability to access certain services. However, the User can configure their computer as follows to refuse the installation of cookies.

  • With Brave : Click Menu (the three horizontal lines or three dots in the top-right corner). Go to Settings. click on « Privacy and security. » And then on Site &Shield Settings. Click the permission you want to update.

Article 18 – Social networks 

The Editor’s site uses plug-ins from the following social networks: Facebook, Instagram, LinkedIn, Twitter (plug-in = extension that integrates with your application to provide new functionalities. A plug-in cannot function independently and is often created by users).  

Social plugins are identical to the logos of the facebook.com Internet websites. 

When the User calls up, on the Editor’s Site, an Internet page containing such social plug-ins, a direct connection is set with such networks’ servers.  The image seen by the User of the plug-in and the underlying functions are then directly transferred to the User’s navigator, and such navigator integrates them.  

Thus, the Editor draws the User’s attention to the fact that the content and volume of the data so collected and directly transferred to such social network by the social plug-in, as well as the recording time and the purpose of the use, are solely determined by such provider.

Article 19 – Right to lodge a claim with a supervisory authority  

The Editor aims to find an amicable settlement to any litigation that may arise.  

Nevertheless, any User may lodge a claim with the supervisory authority.  In France, the relevant supervisory authority for personal data protection is the Commission Nationale de l’Informatique et des Libertés (CNIL) (National Commission for Computing and Freedoms), whose web site may be found here: https://www.cnil.fr
